Soluţionare
Respinge ca nefondat recursul declarat de Parchetul de pe lângă Î.C.C.J.; Admite recursul declarat de Ministerul Finanţelor Publice. Modifică în parte sentinţa civilă în sensul că: Admite excepţia lipsei calităţii procesuale pasive a M.F.P. Respinge acţiunea formulată în contradictoriu cu acest pârât, pentru lipsa calităţii procesuale pasive. Menţine celelalte dispoziţii ale sentinţei. Irevocabilă.
