Admite in parte actiunea precizata si completata formulată de reclamanti in contradictoriu cu pârâtii Parchetul de pe langa Inalta Curte de Casatie si Justitie, Parchetul de pe langa Tribunalul Bucuresti. Obliga paratii la plata catre reclamanti a unei despagubiri constând în suma echivalentă sporului de 30% şi 40%, pentru perioada septembrie 2002- august 2003 inclusiv decembrie 2005- martie 2006 din indemnizaţia de încadrare brută lunara spor acordat pentru magistraţii care efectuează urmărirea penală şi judecă fapte de corupţie, cu titlu de prejudiciu pentru discriminare, tinand seama de perioadele in care reclamantii au avut calitatea de magistrati si de sumele incasate de reclamanti pe aceasta perioada cu acest titlu, despagubiri ce urmeaza a fi actualizate pana la plata efectiva. Obliga paratele sa efectueze cuvenitele mentiuni in carnetele de munca ale reclamantilor cu privire la aceste drepturi. Respinge exceptia lipsei calitatii procesuale pasive a chematului in garantie Ministerul Economiei si Finantelor. Admite cererea de chemare in garantie formulata de paratul Ministerul Public- Parchetul de pe langa Inalta Curte de Casatie si Justitie. Obliga pe chematul in garantie sa aloce paratilor sumele necesare platii drepturilor reclamantilor. Respinge cererea formulata impotriva paratilor Ministerul Justitiei si Ministerul Economiei si Finantelor, ca introdusa impotriva unor persoane fara calitate procesuala pasiva. Respinge cererea avand ca obiect cheltuieli de judecata, ca neintemeiata. Cu recurs in 10 zile de la comunicare. Pronuntata in sedinta publica azi 9.08.2007.
