Soluţionare

Admite acţiunea. Obligă pe pârâtă să plătească reclamanţilor contravaloarea aprovizionării de toamnă-iarnă, în cuantum de un salariu minim pe ramură, conform art. 176 alin. 1 şi 2 din CCM la nivelul ramurii energie electrică, termică, petrol şi gaze, din care se vor deduce contribuţiile aferente impozitului şi bugetelor de asigurări sociale (CASS, CAS, şomaj), pentru perioada 2005 - 2008, în funcţie de perioada efectiv lucrată de fiecare dintre reclamanţi, drepturi ce vor fi actualizate cu indicele de inflaţie la data plăţii efective. Obligă pe pârâtă să acorde reclamanţilor ajutorul material reprezentând contravaloarea unei cote de 4000 mc de gaze naturale anual, conform art. 187 din CCM la nivelul ramurii energie electrică, termică, petrol şi gaze, sume cuvenite pentru perioada 2005-2008, în funcţie de perioada efectiv lucrată de fiecare dintre reclamanţi, drepturi ce vor fi actualizate cu indicele de inflaţie. Obligă pe pârâtă să plătească reclamanţilor 8.600 lei cheltuieli de judecată. Definitivă şi executorie de drept. Cu recurs in 10 zile de la comunicare.

Încuviinţează cererea formulată de apărătorul reclamanţilor. Emite adresă către SC PSV COMPANY SA, în sensul celor de mai sus. Amână judecarea cauzei la data de 19 martie 2009. Se citează pârâtul. Încuviinţează proba cu înscrisuri solicitată de apărătorul reclamanţilor. Prorogă discutarea probei cu expertiză contabilă de specialitate, solicitată de apărătorul reclamanţilor, după administrarea probei cu înscrisuri. Pune în vedere apărătorului reclamanţilor să depună la dosar copii certificate de pe carnetele de muncă sau adeverinţe emise de angajator din care să rezulte că reclamanţii au calitatea de angajaţi. Amână judecarea cauzei la data de 05.02.2009. Se citează pârâtul cu menţiunea de a depune la dosar copie certificată de pe contractul colectiv de muncă pe perioada anului 2005-2008, la nivel de ramură şi la nivel de societate. Cu recurs odată cu fondul. Pronunţată în şedinţa publică de la 11 Decembrie 2008 la Tribunalul Argeş, Secţia Civilă – complet specializat de litigii de muncă şi asigurări sociale.
