Admite in parte cererea
Admite în parte acţiunea formulată de Sindicatul Casei de Asigurări de Sănătate Botoşani ,reprezentat de preşedinte Rodica Cociorvă în numeleşi pentrtu membrii de sindicat funcţionari publici în contradictoriu cu pârâta Casa de Asigurări de Sănătate Botoşani .
Respinge excepţia prescrierii acţiunii pentru perioada 1.01.2004-2005 invocată de pârât
Ia act de renunţarea la judecată a reclamantei privind capătul de cerere referitor la anularea actului emis de pârâtă sub nr. P/783/17.03.2008
Obligă pârâta să acorde reclamanţilor suplimentul postului în procent de 25% din salariul de bază şi suplimentul corespunzător treptei de salarizare în procent de 25% din salariul de bază ,sporuri aferente perioadei efectiv lucrate de reclamanţi, începând cu data de 01.01.2004 şi până data pronunţării prezentei sentinţei(17.09.2008.) sume ce se vor actualiza cu indicele de inflaţie la data plăţii efective.
Respinge ca nefondat capătul de cerere privind plata acestor drepturi , începând cu data pronunţării hotărârii şi în continuare.
Cu recurs în termen de 15 zile de la comunicare
