Soluţionare
Decizia nr. 175/R/22.04.2008
Admite recursurile formulate de creditorii D.G.F.P. Bacău şi S.C. E.ON Gaz România S.A. împotriva sentinţei civile nr. 964/SIND/13.12.2007 a Tribunalului Braşov pe care o casează în parte şi, în consecinţă:
Respinge excepţia prematurităţii cererilor privind intrarea în faliment a debitoarei şi trimite cauza spre rejudecare aceleiaşi instanţe în vederea soluţionării cererilor pe fond.
Obligă debitoarea să depună la banca unde are deschis cont curent o cauţiune de 10 % din costul serviciilor prestate debitorului de către creditoarea S.C. E.ON Gaz România S.A. şi neachitate ulterior deschiderii procedurii.
Menţine restul dispoziţiilor din sentinţă.

Amânat
Având în vedere că cererile de amânare în vederea studierii înscrisurilor depuse la dosar, formulate de reprezentanţii intimatei debitoare şi a intimatei creditoare Asociaţia Salariaţilor şi Membrilor Coducerii "Beralbac", îndeplinesc condiţiile prevăzute de art. 96 Cod procedură civilă, urmează să le admită şi să acorde un nou termen de judecată la data de 15.04.2008.
