Admite recursul formulat de recurenţii L***** C*******, Vaidoş Eugen, Bârsan Gavril şi V***** D****, reprezentanţi ai salariaţilor disponibilizaţi prin concediere colectivă ca urmare a declanşării procedurii falimentului la SC HART SA Miercurea Ciuc împotriva sentinţei civile nr.1163/25 mai 2009 pronunţată de judecătorul sindic desemnat în dosarul Tribunalului Harghita nr.733/96/2005.
Casează parţial sentinţa atacată doar în ceea ce priveşte contestaţia formulată de L***** C*******, Vaidoş Eugen,Bârsan Gavril şi V***** D****, respinge excepţia tardivităţii şi trimite cauza judecătorului sindic pentru a soluţiona pe fond contestaţia acestora.
