Soluţionare
respinge ca nefondat recursul formulat de M.J.
Admite recursul frmulat de M.F.P. şi în consecinţă, modifică în parte hotărârea recurată.
Admite excepţia lipsei calităţii procesuale pasive a recurentei - pârâte M.E.P. şi respinge acţiunea formulată în contradictoriu cu această pârâtă pentru lipsa calităţii procesuale pasive.
Menţine celelalte dispoziţii ale hotărârii recurate.

Având în vedere Hot.nr.3 din 2.09.2009 a Adunării Generale a judecătorilor Curţii de Apel Bacău acordă termen la data de 19 oct.2009, C5 pentru când se vor cita părţile lipsă, se va soluţiona cererea de abţinere a magistraţilor care au calitatea de reclamanţi în cauză şi se va stabili compunerea completului de judecată.
