Soluţionare
Respinge, ca nefondat, recursul declarat de recurenta S.C. RETROM S.A Paşcani.
Admite recursul declarat de lichidatorul judiciar al debitoarei S.C. ROMCONSTRUCT S.A.
Modifică în parte sentinţa în sensul că admite în totalitate cererea formulată de lichidatorul judiciar INVEST EXPERT I.P.U.R.L. şi dispune şi anularea contractului de novaţie prin schimbarea de utilizator nr.CN 10976/26.03.2007 încheiat între debitoarea S.C. ROMCONSTRUCT S.A., S.C. RETROM S.A şi B.R.D. SOCELEASE IFN S.A şi repunerea părţilor în situaţia anterioară încheierii contractului. Menţine celelalte dispoziţii ale sentinţei recurate.
