Soluţionare
: În baza art. 379 pct. 2 lit. a C.pr.pen. admite apelul declarat de inculpatul Ştefan Traian, fiul lui Dumitru şi Elena, născut la data de 06.01.1957 împotriva sentinţei penale nr. 55 din 20.01.2009 a Judecătoriei Slobozia pe care o desfiinţează numai cu privire la cu privire la greşita condamnare a inculpatului şi rejudecând, în baza art. 11 pct. 2 lit. b C.pr.pen. raportat la art. 10 lit. g C.pr.pen încetează procesul penal pornit împotriva acestuia pentru infracţiunea de nerespectare a interdicţiilor privind utilizarea pe terenurile agricole de produse de protecţie a plantelor sau îngrăşăminte chimice, prev. de art. 98 alin. 3 pct. 1 din OUG 195/2005 prin raportare la art. 38 lit. c şi d din acelaşi act normativ.
Menţine dispoziţiile privind acţiunea civilă.
Cheltuielile judiciare avansate de stat rămân în sarcina acestuia.
Cu recurs în 10 zile de la pronunţare pentru procuror şi pentru intimata parte civilă Cioară Niţă şi intimatele părţi vătămate Miuţescu Gabriel, Ercuş Florica şi Perici – Bachici Georgeta şi de la comunicare pentru părţi lipsă.
Pronunţată în şedinţă publică astăzi, 13.03.2009.
