Soluţionare

D E C I D E : În tem.art.385 ind.15 pct.2 lit.c C.p.p admite recursul declarat de petentul S********** V***** F******* împotriva sentinţei penale nr.456/PI/2.10.2009 pronunţată de Tribunalul Timiş. Casează sentinţa penală recurată şi trimite cauza spre rejudecare primei instanţe respectiv Tribunalului Timiş. În tem.art.192 al.3 C.p.p cheltuielile judiciare avansate de stat în recurs rămân în sarcina acestuia. Definitivă.
