Respinge excepţia lipsei calităţii procesuale pasive a Comunei Miceşti. Admite, în parte, acţiunea. Obligă pe pârâta Şcoala Miceşti să calculeze reclamanţilor drepturile salariale rezultate din neaplicarea Legii nr. 221/2008 şi să le plătească acestora diferenţele dintre drepturile salariale efectiv încasate şi cele cuvenite în conformitate cu prevederile Legii nr. 221/2008 pentru aprobarea OG nr. 15/2008, începând cu data de 01.10.2008 si pana la 31.12.2009, în raport de perioada efectiv lucrată, urmând ca aceste sume să fie actualizate în raport de indicele de inflaţie la data plăţii efective. Obligă pe pârâta Comuna Miceşti, prin Primar, să vireze celeilalte pârâte fondurile necesare achitării acestor drepturi. Admite excepţia lipsei calităţii procesuale pasive a chemaţilor în garanţie Inspectoratul Şcolar Judeţean Argeş şi Judeţul Argeş. Respinge cererea de chemare în garanţie faţă de aceste persoane ca fiind formulată împotriva unor persoane fără calitate procesuală pasivă, iar faţă de MFP, DGFP şi MECI, ca neîntemeiată. Respinge cererea privind plata cheltuielilor de judecată ca neîntemeiată. Definitivă şi executorie de drept. Cu recurs în 10 zile de la comunicare. Pronunţată în şedinţă publică, azi, 14.04.2010.
