Încheiere
Apreciind că dreptul la un proces echitabil şi dreptul de a fi judecat de o instanţă independentă şi imparţială constituie principii fundamentale, consfinţite de art. 6 din Convenţie, pe care instanţa trebuie să le aplice cu prioritate,
Văzând că subfinanţarea generală a sistemului judiciar afectează nu doar independenţa, ci însăşi existenţa justiţiei ca serviciu public în slujba cetăţeanului, negând România ca stat de drept,
Consecvent Hotărârii Adunării Generale a Judecătorilor Curţii de Apel Timişoara din data de 2.09.2009, potrivit căreia în materie civilă vor fi soluţionate doar cauzele vizând plasamentul minorilor, iar restul cauzelor civile vor fi amânate,
Cum prezenta cauză nu se încadrează în categoria amintită, urmează a amâna judecata la un nou termen.
Amână judecarea cauzei la data de 17.11.2009
