Admite cererea. Îndreaptă eroarea materială strecurată în cuprinsul dispozitivului sentinţei civile nr. 299/CM/22.02.2010, în sensul că obligă pe pârâţi să calculeze şi să acorde personalului didactic şi didactic auxiliar căruia i se aplică OG 11/2007 aprobată prin Legea 220/2007, salariul de bază, după cum urmează: pentru perioada 01.01.2007 - 31.03.2007, luând în calcul ca valoare a coeficientului, 1 suma de 255,889 lei; pentru perioada 01.04.2007-30.09.2007, suma de 261,005 lei şi pentru perioada 01.10.2007-31.12.2007, suma de 300,156 lei. Cu recurs în 10 zile de la comunicare. Pronunţată în şedinţă publică, azi 17 iunie 2010, la Tribunalul Argeş, Secţia Civilă – complet specializat de litigii de muncă şi asigurări sociale

Soluţionare

Admite acţiunea. Obligă pe pârâţii Şcoala nr. 1 Topoloveni şi Centrul Bugetar Liceul „Ion Mihalache” Topoloveni să calculeze şi să acorde personalului didactic, didactic auxiliar şi personalului nedidactic salariul de bază după cum urmează: 1)pentru personalul didactic şi didactic auxiliar căruia i se aplică OG 11/2007 aprobată prin Legea 220/2007 pentru perioada 01.01.2007-01.03.2007 să se ia în calcul ca valoare a coeficientului 1 suma de 255,889 lei; pentru perioada 01.04.2007-30.09.2007, suma de 261,005 lei şi pentru perioada 01.10.2007-31.12.2007, suma de 300,156 lei; 2)pentru personalul nedidactic căruia i se aplică OG 10/2007 aprobată prin Legea 231/2007 ,în cazul în care salariul de bază este sub minimul prevăzut de Contractul Colectiv de muncă la Nivel Naţional, astfel: a)muncitori necalificaţi -440 lei, muncitori calificaţi -528 lei; b)personal administrativ încadrat în funcţii pentru care condiţia de pregătire este liceală - 528 lei, iar postliceală-550 lei; c)personal de specialitate încadrat pe funcţie pentru care condiţia de pregătire este de studii superioare -880 lei; Pentru perioada 01.04.2007-31.09.2007 salariul de bază minim pentru personalul nedidactic va fi majorat cu 2% faţă de nivelul lunii martie 2007 iar pentru perioada 01.10.2007-31.12.2007, cu 11% faţă de nivelul lunii septembrie 2007 . Obligă pe pârâţii Şcoala nr. 1 Topoloveni şi Centrul Bugetar Liceul „Ion Mihalache” Topoloveni să actualizeze drepturile salariale enunţate mai sus în raport de indicele de inflaţie la data plăţii efective. Obligă pe pârâta Şcoala nr. 1 Topoloveni să efectueze menţiunile corespunzătoare în carnetele de muncă ale reclamanţilor. Obligă pe pârâtul Oraşul Topoloveni să vireze pârâţilor de mai sus fondurile necesare achitării drepturilor salariale de mai sus. Obligă pe pârâţii Şcoala nr. 1 Topoloveni şi Centrul Bugetar Liceul „Ion Mihalache” Topoloveni să plătească Sindicatului cheltuieli de judecată în cuantum de 50 lei. Definitivă şi executorie de drept. Cu recurs în 10 zile de la comunicare.
