Admite recursurile declarate de către pârâţii-recurenţi Ministerul Public-Parchetul de pe lângă Înalta Curte de Casaţie şi Justiţie, Parchetul de pe lângă Tribunalul Timiş, Parchetul de pe lângă Curtea de Apel Timişoara, şi Ministerul Finanţelor Publice reprezentat prin Direcţia Generală a Finanţelor Publice Timiş, împotriva sentinţei civile nr. 105/04.11.2008, pronunţată de Curtea de Apel Timişoara în dosarul nr. 5977.1/30/2006.
Casează hotărârea recurată şi trimite cauza spre rejudecare în fond la Tribunalul Timiş.
Irevocabilă.
