Soluţionare
Admite recursul declarat de către Ministerul Finanţelor Publice Bucureşti reprezentat prin Direcţia Generală a Finanţelor Publice Timiş împotriva sentinţei civile nr. 521/PI/CA/08.05.2009 pronunţată în dosar nr. 8984/30/2008 a Tribunalului Timiş.
Admite recursul declarat de către reclamantele recurente D**** C***** şi Periat Cornelia împotriva aceleiaşi sentinţe.
Admite recursul declarat de Autoritatea Naţională Sanitară Veterinară şi pentru Siguranţa Alimentelor Bucureşti împotriva aceleiaşi sentinţe.
Modifică în parte hotărârea recurată, în sensul că admite şi acţiunea reclamantelor D**** C***** şi Periat Cornelia şi obligă pârâta Direcţia Sanitară Veterinară şi pentru Siguranţa Alimentelor Timiş să plătească acestor reclamante un spor actualizat de 15% din salariul de bază pentru perioada cât au fost funcţionari publici, în intervalul 01.01.2007-01.10.2008.
Respinge acţiunea reclamanţilor faţă de pârâtele Autoritatea Naţionala Sanitara Veterinara şi pentru Siguranţa Alimentelor Bucureşti şi Ministerul Finanţelor Publice Bucureşti, ca fiind îndreptată împotriva unor instituţii fără calitate procesuală pasivă în cauză.
Menţine în rest dispoziţiile hotărârii recurate.
Fără cheltuieli de judecată.
Irevocabilă.
Pronunţată în şedinţa publică din data de 19.01.2010.
Cu opinie separată în ce priveşte calitatea procesuală a ANSV SA,
