Admite recursul declarat de DGFP B-ţa N în nume propriu şi în numele MFP împotriva sentinţei civile nr. 419/F din 12.11.2009 pronunţată de Tribunalul B-ţa N în dosar nr. 2198/112/2008, pe care o casează în tot şi dispune trimiterea cauzei spre competentă soluţionare Tribunalului B-ţa N., în jurisdicţie de contencios administrativ.
