Soluţionare

Respinge recursul formulat de Inspectoratul Şcolar Judeţean Suceava ca nefondat. Admite recursul formulat de Ministerul Educaţiei Cercetării, Tineretului şi Sportului. Modifică în parte sentinţa civilă nr. 1031/2010 a Tribunalului Botoşani în sensul că: Admite cererea de chemare în garanţie a Ministerului Finanţelor Publice formulată de MFCTS. Obligă chematul în garanţie să aloce fondurile necesare plăţii drepturilor băneşti acordate reclamanţilor prin sentinţa recurată. Menţine celelalte dispoziţii ale sentinţei recurate care nu sunt contrare prezentei decizii. Irevocabilă.
