Soluţionare
Respinge ca nefondat recursul declarat de Inspectoratul Şcolar al jud. Botoşani .
Admite recursul declarat de Ministerul Educaţiei, cercetării şi Tineretului şi Sportului.
Modifică în parte s.c. nr. 1355/30.06.2009 a Tribualului Botoşani, în sensul că:
Respinge excepţia lipsei calităţii procesuale pasive a Ministerului Finanţelor Publice , ca nefondată.
ADMITE cererea de chemare în garanţie a Ministerului Finanţelor Publice formulată de MECTS.
Obligă chematul în garanţie să aloce fondurile necesare plăţii drepturilor băneşti acordate reclamanţilor prein sentinţa recurentă.
Menţine celelalte dispoziţii ale sentimţei care nu sunt contrare prezentei decizii.
Irevocabilă.
