Soluţionare
Respinge excepţia lipsei calităţii lor procesuale pasive invocată de pârâţii CL Călăraşi, P Călăraşi, U AT Călăraşi.
Admite excepţia nulităţii deciziilor de imputare emise de pârâtul Şcoala pentru membrii de sindicat R M şi S S invocată din oficiu.
Admite acţiunea formulată de reclamantul Sindicatul Liber din Învăţământ Călăraşi în numele membrilor săi de sindicat.
Constată nule menţionatele decizii de imputare.
Obligă pârâtul Şcoala către membrii de sindicat la restituirea sumelor reţinute din salariu în luna septembrie 2010, fără existenţa unui titlu executoriu.
Obligă pârâţii CL Călăraşi, P Călăraşi şi UA T a Municipiului Călăraşi să asigure finanţarea şi virarea sumelor necesare către pârâtul Şcoala pentru plata sumelor reţinute din salariu în luna septembrie 2010.
Definitivă şi executorie de drept.
Cu recurs în 10 zile de la comunicare.
Pronunţată în şedinţă publică.
