Soluţionare
Disjunge recursul promovat de Colceru Anca Mariana.
Fixează termen 24 ianuarie 2011 pentru când se vor cita recurenta şi intimata.
Admite recursul promovat de ceilalţi reclamanţi.
Modifică, în tot, sentinţa recurată în sensul că:
Respinge excepţia prematurităţii.
Admite în parte acţiunea formulată de reclamanţi cu excepţia reclamantei Colceru Anca MAriana.
Obligă pârâta să plătească reclamanţilor cota-parte de 5 % din profitul net aferent anilor 2005-2007 corespunzător perioadei efectiv lucrate, după următorul algoritm:
- 135,50 lei/lună - pentru anul 2005 - x lunile efectiv lucrate
- 290 lei/ lună - pentru anul 2006 - x lunile efectiv lucrate
- 280,66 lei/ lună- pentru anul 2007 - x lunile efectiv lucrate, sumele rezultate fiind sume brute.
Irevocabilă.
Pronunţată în şedinţa publică, azi 13 decembrie 2010.
