Admite acţiunea.
Respinge ca nefondată excepţia lipsei calităţii procesuale pasive a Consiliului Local Galaţi.
Obligă pârâţii Consiliul Local Galaţi şi Şcoala Gimnazială nr. 5 „Cuza Vodă” Galaţi să plătească reclamanţilor prima de vacanţă aferentă anilor 2008 - 2009, în cuantum de un salariu de bază din luna anterioară plecării în concediu, actualizată cu indicele de inflaţie începând cu data naşterii dreptului şi până la data plăţii, actualizate cu indicele de inflaţiei la data plăţii.
Respinge cererea de chemare în garanţie a I.S.J. Galaţi pentru lipsa calităţii procesuale pasive.
Cu recurs în termen de 10 zile de la comunicare.
