Soluţionare

Admite recursul declarat de pârâtul Ministerul Justiţiei şi Libertăţilor Cetăţeneşti. Modifică în parte s.c. nr. 466 C din 8.05.2009 pronunţată de Tribunalul Neamţ în dosarul nr. 879/32/2008 în sensul că: Respinge acţiunea ca nefondată. Menţine dispoziţia prin care a fost soluţionată excepţia privind lipsa calităţii procesuale pasive a pârâtului Ministerul Finanţelor Publice. Respinge recursul declarat de pârâtul Ministerul Finanţelor Publice ca nefondat. Irevocabilă. Pronunţată în şedinţă publică.
