Soluţionare
Respinge excepţia lipsei calităţii procesuale pasive a Consiliului Local Bacău. Admite în parte acţiunea formulată de către reclamanţi, toţi prin reprezentant legal S********* L**** D** Î*********** J******** B**** în contradictoriu cu pârâţii Şcoala cu clasele I-VIII „Georgeta şi Mircea Cancicov" Bacău, Consiliul Local Bacău şi Municipiul Bacău, prin primar. obligă pârâta Şcoala cu clasele I-VIII „Georgeta şi Mircea Cancicov” Bacău să calculeze şi să plătească reclamanţilor indemnizaţia de concediu de odihnă pentru perioada de concediu efectuat până la data de 02.07.2010, inclusiv. în cuantum nediminuat cu 25%. Obligă pârâtul Consiliul Local Bacău şi U.AT BACĂU la asigurarea finanţării plăţii sumelor sus-menţionate. Definitivă. Executorie. Cu recurs în 10 zile de la comunicare. Pronunţată în şedinţă publică, cu opinia separată a asistenţilor judiciari Popa-Gavrilovici Gioni şi Chirilă Brânduşa care sunt pentru admiterea acţiunii în totalitate.
