Admite recursul. Modifică în parte sentinţa civilă nr. 1783 din 29.09.2011 pronunţată de Tribunalul Suceava în dosarul nr. 1863/86/2011, în sensul că: Admite excepţia lipsei calităţii procesuale pasive a pârâtului Ministerul Finanţelor Publice. Respinge acţiunea formulată în contradictoriu cu pârâtul Ministerul Finanţelor Publice, ca fiind formulată împotriva unei persoane fără calitate procesuală pasivă. Menţine celelalte dispoziţii ale sentinţei civile, care nu sunt contrare prezentei decizii. Irevocabilă. Pronunţată în şedinţă publică.
