Admite recursul declarat de chematul în garanţie MINISTERUL FINANŢELOR PUBLICE BUCUREŞTI prin DIRECŢIA GENERALĂ A FINANŢELOR PUBLICE BRĂILA.
Modifică în parte sentinţa civilă nr. 985/14.07.2011 a Tribunalului Brăila şi, în rejudecare:
Respinge ca nefondată cererea de chemare în garanţie a MINISTERULUI FINANŢELOR PUBLICE.
Menţine celelalte dispoziţii ale sentinţei civile recurate.
Respinge ca fiind tardiv recursul declarat de pârâtul I************ Ş***** J******* BRĂILA împotriva aceleiaşi sentinţe.
