Soluţionare
În baza art. 38515 pct. 1 lit. b Cpp respinge ca nefondat recursul declarat de Parchetul de pe lângă Tribunalul Arad, împotriva sentinţei penale nr. 270 din 30.05.2011 pronunţată de Tribunalul Arad în dosar nr. 2461/108/2011 şi în consecinţă menţine hotărârea atacată.
În baza art. 192 alin. 3 Cod procedură penală cheltuielile judiciare avansate de stat în recurs rămân în sarcina statului.
În baza art. 189 Cod procedură penală dispune virarea din fondul MJ către Baroul Timiş a sumei de 2400 lei cu titlu de onorariu avocat din oficiu.

în temeiul art. 300 ind. 2 C.p.p. rap. la art. 160 ind. b C.p.p. a menţinut starea de arest a inculpaţilor DRĂGAN IONEL DOREL – n. 26.01.1974, TANCHIŞ IOAN – n. 03.02.1951, DICU IOAN – n. n. 01.10.1963 şi CAICAŞ VASILE VIOREL – n. n. 21.02.1969, urmând ca legalitatea şi temeinicia acesteia să fie verificate înainte de expirarea termenului legal de 60 zile.
