Respingere recurs

Respinge recursul ca nefondat. Irevocabilă. Pronunţată în şedinţa publică din 28 februarie 2012. OPINIE SEPARATĂ: Admite recursul. Modifică în parte sentinţa civilă nr. 2081 din 27.10.2011 a Tribunalului Suceava, în sensul că admite excepţia lipsei calităţii procesuale pasive a MFP şi respinge cererea reclamanţilor în contradictoriu cu MFP ca fiind formulată împotriva unei persoane fără calitaate procesuală pasivă. Menţine celelalte dispoziţii ale sentinţei, care nu sunt contrare prezentei decizii.
