Admitere recurs
Admite recursul pârâtului Ministerul Finanţelor Publice.
Modifică în parte sentinţa civilă nr.1263/C/28.09.2011 în sensul că:
Admite excepţia lipsei calităţii procesuale pasive a pârâtului Ministerul Finanţelor Publice şi în consecinţă:
Respinge acţiunea formulată în contradictoriu cu acest pârât pentru lipsa calităţii procesuale pasive şi înlătură obligaţia stabilită prin sentinţa recurată în sarcina acestuia.
Menţine celelalte dispoziţii ale sentinţei recurate.
Respinge, ca nefondat, recursul declarat de pârâtul Inspectoratul Şcolar Judeţean Neamţ.
Irevocabilă.
