Admite in parte cererea
Admite în parte acţiunea.
Obligă pe pârâta Şcoala Săpata să calculerze şi să achite reclamanţilor diferenţele dintre indemnizaţia de concediu cuvenită pentru anul şcolar 2009-2010 fără aplicarea diminuării de 25% prevăzută de art.1 alin.1 din Legea nr.118/2010 şi indemnizaţia de concediu efectiv încasată pentru zilele de concediu de odihnă efectuate înaintea datei de 3 iulie 2010, sume ce se vor actualiza cu indicele de inflaţie la data plăţii efective.
Obligă pe pârâta Comuna Săpata, prin Primar, să vireze pârâtei de mai sus fondurile necesare achitării drepturilor acordate.
Cu recurs în 10 zile de la comunicare.
Pronunţată în şedinţă publică, azi 09 aprilie 2012, la Tribunalul Argeş - Secţia Conflicte de Muncă şi Asigurări Sociale.
