Soluţionare

Respinge excepţia inadmisibilităţii acţiunii, invocată de pârâtul Ministerul Finaţelor Publice. Admite acţiunea formulată de reclamanta UNIUNEA SINDICATELOR DIN ÎNVĂŢĂMÂNT (U.S.Î.) VÂLCEA, cu sediul în Rm.Vâlcea, str. N. Bălcescu, nr. 30, jud. Vâlcea - în numele membrilor de sindicat nominalizaţi. Obligă pârâta unitatea şcolară la plata sumelor reprezentând diferenţa dintre ajutorul financiar pentru achiziţionarea de cărţi sau de programe educaţionale pe suport electronic necesare îmbunătăţirii calităţii activităţii didactice în învăţământul preuniversitar, ajutor prevăzut de Legea nr. 315/2006, aferent anului 2009 şi suma efectiv plătită, precum şi plata ajutorului financiar corespunzător perioadei din anul 2010, până la data de 03.07.2010, sume actualizate în funcţie de rata inflaţiei la data plăţii efective. Obligă pârâtul I************ Ş***** J******* V***** să aloce către unitatea de învăţământ sumele necesare plăţii integrale a ajutorului prevăzut de Legea nr. 315/2006. Obligă pârâtul M********* E********* C********** T********** Ş* S******** să aloce Inspectoratului Şcolar sumele necesare plăţii integrale a ajutorului prevăzut de Legea nr. 315/2006. Obligă pârâtul Ministerul Finanţelor Publice să vireze în bugetul Ministerului Educaţiei, Cercetării, Tineretului şi Sportului a sumelor necesare plăţii integrale a acestui ajutor. Definitivă şi executorie. Cu recurs în 10 zile de la comunicare. Pronunţată în şedinţa publică de la 16.01.2012, la sediul Tribunalului Vâlcea.
