Admite in parte cererea
Respinge ca nefondată excepţia lipsei calităţii procesuale active a Sindicatului Liber al Reviziei de vagoane Barboşi – Triaj.
Respinge ca nefondată excepţia prescrierii dreptului material la acţiune invocată în temeiul disp. art. 268 alin. 1 lit. e din C. muncii.
Admite excepţia prescrierii dreptului material la acţiune privind plata primei aferentă Zilei Feroviarilor pe anii 2007 şi 2008 şi plata salariului suplimentar pe anul 2007.
Respinge ca nefondată excepţia inadmisibilităţii.
Admite în parte acţiunea.
Obligă pe pârâte să plătească reclamanţilor prima aferentă Zilei Feroviarilor pe anul 2009, ajutorul material cu ocazia sărbătorilor de Pa?ti şi Crăciun pe anul 2009, salariile suplimentare pe anii 2008 şi 2009, actualizate cu indicele de inflaţie la data plăţii.
Respinge ca fiind prescrise drepturile băneşti reprezentând prima aferentă Zilei Feroviarilor pe anii 2007 şi 2008 şi salariul suplimentar pe anul 2007.
Respinge ca nefondat capătul de cerere privind plata cheltuielilor de judecată.
