Respinge exceptia lipsei calitatii de reprezentant a Sindicatului Liber si Independent al Reviziei de Vagoane Faurei.
Respinge exceptia prescriptiei extinctive in baza art.268 alin.1 lit.e codul muncii.
Admite exceptia prescriptiei extinctive in baza art.268 alin.1 pct.c codul muncii in ceea ce priveste prima pentru Ziua Feroviarului aferenta anilor 2007-2008 si salariul suplimentar aferent anului 2007.
Admite in parte actiunea formulata de reclamanti prin Sindicatul Liber si Independent al Reviziei de Vagoane Faurei in contradictoriu cu paratele Societatea Nationala de Transport Feroviar de Marfa “CFR Marfa” SA Bucuresti si Societatea Nationala de Transport Feroviar de Marfa “CFR Marfa” SA Bucuresti – Sucursala Moldova – Centrul Zonal Marfa Galati.
Obliga pe parate sa plateasca reclamantilor ajutoarele materiale pentru sarbatoarea de Paste din anul 2009, sarbatoarea de Craciun din anul 2009, Ziua Feroviarului din anul 2009, salariul suplimentar din anii 2008-2009, sume actualizate in raport cu rata inflatiei la data platii efective.
Obliga pe parate sa plateasca reclamantilor cate 50 lei cu titlu de cheltuieli judecata.
