Admite recursurile.
Modifică în parte sentinţa civilă nr. 193 din 27 ianuarie 2011 a Tribunalului Botoşani, în sensul că:
Obligă pârâtul Colegiul Naţional "A.T.Laurian" Botoşani să calculeze indemnizaţia aferentă concediului de odihnă pentru anul şcolar 2009 – 2010 în conformitate cu dispoziţiile art. 145 alin. 2 din Codul muncii.
Menţine celelalte dispoziţii ale sentinţei care nu sunt contrare prezentei decizii.
Respinge cererea recurentului Colegiul Naţional "A.T.Laurian" Botoşani de suspendare a executării sentinţei civile nr. 193 din 27 ianuarie 2011, ca rămasă fără obiect.
Irevocabilă.
Pronunţată în şedinţa publică din 17 mai 2011.
