Admitere recurs
Admite recursul declarat de Consiliul Judeţean Botoşani. Modifică în parte sentinţa civilă nr. 480 din 17 februarie 2011 a Tribunalului Botoşani şi în rejudecare:
Admite în parte acţiunea. Obligăpârâţii Şcoala de arte şi meserii "Ion Pillat" şi Consiliul judeţean Botoşani să achite reclamanţilor diferenţele dintre indemnizaţia de concediu cuvenită pentru anul şcolar 2009-2010 fără aplicarea diminuării de 25% prev. de art. 1 alin. 1 din legea nr. 118/2010 şi indemnizaţia de concediu efectiv încasată pentru zilele de concediu de odihnă efectuate înaintea datei de 3 iulie 2010, sume actualizate în raport de rata inflaţiei, drepturile salariale de la data scadenţei până la data plăţii efective.
Respinge ca nefondată cererea reclamanţilor de acordare a aceloraşi drepturi pentru zilele de concediu de odihnă efectuate după data de 3 iulie 2010, inclusiv. Menţine celelalte dispoziţii ale sentinţei care nu sunt contrare prezentei decizii. Irevocabilă.
