Legea 85/2006 privind insolventa
Respinge contestaţia formulată de Banca Românească SA la hotărârea adunării creditorilor din 20.01.2012.
În temeiul art. 101 din Legea nr.85/2006,
Confirmă planul de reorganizare a debitoarei S* P********* I**** S**, plan propus de debitoare, şi dispune reorganizarea activităţii debitoarei în mod corespunzător, pe o perioadă de 3 ani.
Dispune ca supravegherea activităţii debitoarei, exercitată de reprezentanţii săi legali, să se facă de administratorul judiciar desemnat.
În temeiul art.106 din Legea nr.85/2006,
Obligă debitoarea şi administratorul judiciar să prezinte comitetului creditorilor rapoarte trimestriale asupra situaţiei financiare a debitoarei, ulterior aprobării acestea urmând să fie depuse la dosar.
Acordă termen la data de 06.09.2012 pentru depunerea raportului asupra situaţiei financiare a debitoarei.
Dispune efectuarea din oficiu a menţiunilor în Registrul Comerţului de pe lângă Tribunalul Dolj.
Definitivă. Cu recurs în 7 zile de la comunicare.

Amână cauza
Se citează părţile pentru discutarea propunerii de confirmare a planului, administratorul judiciar urmând să depună tabelul definitiv rectificat al creanţelor în ceea ce priveşte înscrierea creditoarei Bank of Cyprus Public Company Limited cu o creanţă garantată.
Acordă termen la data de 26 ianuarie 2012.
