Admite cererea

Admite excepţia lipsei calităţii procesuale pasive, invocată de pârâtă, raportat la acţiunea formulată de reclamantul Moisii Niculaie. Respinge acţiunea formulată de reclamantul Moisii Niculaie ca fiind introdusă împotriva unei persoane lipsite de calitate procesuală pasivă. Respinge ca nefondate celelalte excepţii invocate de pârâtă. Admite acţiunea. Obligă pârâtele la plata în favoarea reclamanţilor a sumei reprezentând diferenţa dintre drepturile salariale efectiv încasate pentru perioada octombrie 2009 - decembrie 2010, şi cele cuvenite ca urmare a stabilirii salariului de bază brut prin raportare la salariul de bază minim brut la nivelul ramurii transporturi de 700 lei, prevăzut de art. 41 alin. 1 lit. a din Contractul colectiv de muncă unic la nivel de ramură transporturi pe anii 2008-2010, cu aplicarea coeficienţilor de ierarhizare precum şi a celorlalte sporturi prevăzute în Contractul colectiv de muncă la nivel de unitate, cu incidenţă pentru perioada în cauză, cu actualizarea sumei datorate în funcţie de rata inflaţiei. Respinge ca nefondat capătul de cerere privind obligarea pârâtelor la plata cheltuielilor de judecată. Cu recurs. Pronunţată în şedinţă publică.
