Admite in parte cererea
Admite excepţia prescripţiei extinctive în ceea ce priveşte diferenţele de drepturi salariale solicitate pe perioada 01.10.2008- 30.04.2009.
Respinge ca fiind prescrise pretenţiile solicitate pe perioada 01.10.2008-30.04.2009.
Admite excepţia lipsei calităţii procesuale pasive în ceea ce priveşte pe pârâtul Consiliul Judeţean Vrancea.
Respinge acţiunea formulată împotriva pârâtului Consiliul Judeţean Vrancea ca fiind introdusă împotriva unei persoane fără calitate procesuală pasivă.
Admite în parte acţiunea.
Obligă pârâţii (unităţi şcolare, ISJ (doar în privinţa persoanelor care au avut raporturi contractuale cu acesta) şi consiliile locale ce au calitatea de ordonatori secundari de credite ai fiecărei unităţi de învăţământ) să plătească membrilor de sindicat în numele cărora a fost introdusă acţiunea de faţă şi pentru care sunt îndeplinite cerinţele art. 28 din Legea nr. 62/2011, drepturile băneşti reprezentând diferenţa dintre drepturile salariale încasate şi drepturile salariale calculate potrivit Legii nr. 221/2008, începând cu 01.05.2009 şi până la 31.12.2009, sumele urmând a fi reactualizate în raport de indicele de inflaţie, începând cu data la care trebuiau plătite până la efectiva achitare.
Cu recurs în 10 zile de la comunicare.
