Admitere apel

Admite recursul declarat de pârâtul Ministerul finanţelor publice, cu sediul în municipiul Bucureşti, str. Apollodor, nr. 17, sector 5 – prin Direcţia generală a finanţelor publice Suceava, cu sediul în str. Vasile Bumbac, nr. 7, judeţul Suceava, împotriva sentinţei nr. 2520 din 6 decembrie 2011 pronunţată de Tribunalul Suceava. Modifică în parte sentinţa civilă nr. 2520 din 6 decembrie 2011 a Tribunalului Suceava şi, în rejudecare: Admite excepţia lipsei calităţii procesuale pasive a pârâtului Ministerul finanţelor publice. Respinge acţiunea formulată de reclamanţi faţă de acest pârât ca inadmisibilă. Înlătură dispoziţia de obligare a pârâtului recurent de a aloca pârâtului Ministerul educaţiei, cercetării, tineretului şi sportului fondurile necesare plăţii sumelor stabilite prin sentinţă. Menţine celelalte dispoziţii ale sentinţei care nu sunt contrare prezentei decizii. Irevocabilă. Pronunţată în şedinţă publică, azi, 01.03.2012. Cu opinie separata, în sensul : Respinge recursul ca nefondat.
