Admite recursul.
Modifică în parte sentinţa civilă nr. 85 din 24.ian.2012 a Tribunalului Neamţ în sensul că:
Admite excepţia lipsei calităţii procesuale pasive a Ministerului Finanţelor Publice şi respinge pentru lipsa calităţii procesuale pasive acţiunea formulată împotriva pârâtului Ministerul Finanţelor Publice.
Menţine celelalte dispoziţii ale sentinţei.
