Modifică sentinţa

Admite recursul. Modifică parţial sentinţa atacată în sensul că admite excepţia lipsei calităţii procesuale pasive a MFP şi respinge acţiunea faţă de acest pârât. Înlătură dispoziţia de obligare a MFP la alocarea către MECTS a sumelor necesare achitării drepturilor băneşti solicitate de reclamanţi. Menţine celelalte dispoziţii ale sentinţei. Irevocabilă. Pronunţată în şedinţa publică din 3.05.2012.
