Respinge recursul, ca nefondat. Irevocabilă. Pronunţată în şedinţa publică din 3 aprilie 2012.
Cu opinia separată a doamnei judecător Mitrea Muntean Daniela, în sensul: Admite recursul. Modifică în parte sentinţa civilă nr. 2747/19.12.2011 a Tribunalului Suceava, în sensul că admite excepţia lipsei calităţii procesuale pasive a M.F.P. şi respinge cererea reclamanţilor în contradictoriu cu M.F.P., ca fiind formulată împotriva unei persoane fără calitate procesuală pasivă. Menţine celelalte dispoziţii ale sentinţei, care nu sunt contrare prezentei decizii.
