Respinge recursurile ca nefondate. Irevocabilă. Pronunţată în şedinţa publică din 05 aprilie 2012. Opinie separată a domnişoarei Plăcintă Dochiţa: Admite recursul declarat de Ministerul Educaţiei, Cercetării, Tineretului şi Sportului. Modifică parţial sentinţa atacată, în sensul că admite excepţia lipsei calităţii procesuale a Ministerului Educaţiei, Cercetării, Tineretului şi Sportului şi respinge acţiunea faţă de acest pârât. Menţine celelalte dispoziţii ale sentinţei. Respinge ca nefondate recursurile declarate de Inspectoratul Şcolar Judeţean Botoşani şi Consiliul Local Botoşani. Irevocabilă.
