Admite cererea
Respinge ca neintemeiata exceptia lipsei calitatii procesuale pasive a Consiliului Local sector 5 bucuresti si a Municipiul Bucuresti – Sector 5 .
Admite acţiunea.
Obligă pârâţii la calculul şi plata diferenţelor dintre drepturile salariale încasate şi cele cuvenite după reîncadrare cu salariul majorat, conform prevederilor Legii nr. 330/2009 şi 284/2010 şi 285/2010 având ca bază de calcul salariul rezultat la data de 31.12.2009,după aplicarea majorărilor prevăzute de Legea nr. 221/2008, începând cu data de 01.01.2010 până la data de 12.05.2011, actualizate cu indicele de inflaţie la data plăţii efective.
Cu recurs în 10 zile de la comunicare.
