Admitere recurs
Admite recursul declarat de pârâtul Ministerul Educaţiei, Cercetării, Tineretului şi Sportului. Modifică în parte sentinţa civilă nr. 3865 din 7.10.1011 pronunţată de Tribunalul Botoşani în dosarul nr. 4474/40/2011 în sensul că: Admite excepţia lipsei calităţii procesuale pasive a pârâtului Ministerul Educaţiei, cercetării, Tineretului şi Sportului. Respinge acţiunea formulată în contradictoriu cu acest pârât ca fiind formulată împotriva unei persoane fără calitate procesuală pasivă. Menţine celelalte dispoziţii ale sentinţei care nu sunt contrare prezentei decizii. Respinge ca nefondat recursul declarat de pârâtul Consiliul Local al municipiului Botoşani. Irevocabilă. pronunţată în şedinţă publică.
