Admite in parte cererea
Respinge exceptia lipsei calitatii procesuale pasive a Ministerului Educatiei, Cercetarii si Inovarii.
Admite in parte actiunea asa cum a fost formulata si completata de Sindicatul Bibliotecii Centrale Universitare „Mihai Eminescu” Iasi . Obliga parata Biblioteca Centrala Universitara Mihai Eminescu la calculul si plata diferentelor dintre drepturile salariale efectiv incasate si cele cuvenite potrivit Legii nr.221/2008 raportat la dispozitiile Legii nr. 330/2009 pentru perioada 01.01.2010-31.12.2010, sume ce urmeaza a fi actualizate cu indicele de inflatie la data platii efective.
Obliga paratul Ministerul Educatiei Cercetarii si Inovarii sa aloce fondurile necesare platii drepturilor salariale de mai sus.
Respinge cererea privind obligarea paratei Biblioteca Centrala Universitara Mihai Eminescu la plata a sporurilor de fidelitate, suprasolicitare neuropsihica, de vechime, de doctorat si de penibilitate.
Respinge actiunea formulata de Sindicatul Bibliotecii Centrale Universitare „Mihai Eminescu” Iasi incepand cu 01.01.2011 si pe viitor.
Respinge actiunea formulata de reclamantii care au calitatea de personal nedidactic.
Respinge actiunea in contradictoriu cu paratul Ministerul Finantelor Publice cu sediul in Bucuresti, str. Apollodor, nr.17, sector 5.
Obliga reclamantii sa achite paratei Biblioteca Centrala Universitara Mihai Eminescu suma de 1000 lei reprezentand cheltuieli de judecata.
