Respins
Respinge ca nefondată cerera formulată de reclamantul IPJ Botoşani în contradictoriu cu pârâtul AGAFITEI GHEORGHE, fostul lichidator al debitoarei SC ALCOR SA Botoşani. Admite acţiunea formulată de reclamantul debitor S* A**** S* B******** P*** L********* J******* C** I***** I**** Iaşi, în contradictoriu cu pârâtul AGAFIŢEI GHEORGHE.În temeiul art. 22 alin. 4 din Legea nr. 85/2006, obligă pârâtul AGAFIŢEI GHEORGHE, fostul lichidator al debitorului SC ALCOR SA să aducă la masa credală suma de 24.393,36 lei onorariu încasat necuvenit, suma de 6.197,14 lei dobândă legală la onorariul încasat necuvenit, suma de 114.000 lei, cu tilu de daune materiale şi 13.744,98 lei cu titlu de dobândă legală, în total suma de 158.335,48 lei. Cu recurs. Pronunţată în şedinţa publică.
