Admite recursul. Modifică în totalitate sentinţa nr. 751 din 3 nov. 2011 a Trib. Botoşani, în sensul că: Admite contestaţia creditoarei DGFP Botoşani. Modifică în parte raportul asupra fondurilor obţinute din lichidare şi a planului de distribuire a sumelor aferente între creditori, întocmit de CII Dascălu Constantin-Lulu, în sensul că înlătură dispoziţiile referitoare la acordarea lichidatorului judiciar a unui onorariu de succes de 4% din fondurile obţinute din lichidare. Constată că începând din data de 24.03.2011 lichidatorul judiciar este îndreptăţit doar la onorariul stabilit prin sentinţa nr. 243 din 24 martie 2011 a Tribunalului Botoşani. Respinge ca nefondată cererea reconvenţională. Irevocabilă.
