Modifică sentinţa
Admite recursul.
Modifică în parte sentinţa civilă recurată, în sensul că:
Admite acţiunea formulată de reclamanţii Mihai Elena şi M**** Z******.Obligă pârâta la restituirea sumelor reprezentând diferenţe dintre drepturile de pensie calculate prin aplicarea procentului de contribuţie de asigurări sociale de sănătate asupra întregului cuantum al pensiei şi pensiile nete rezultate prin aplicarea procentului de contribuţie de asigurări sociale de sănătate asupra părţii din pensie care depăşeşte nivelul de 740 lei, pentru perioada: ianuarie 2011 - aprilie 2012, conform eşalonării prevăzute de OUG nr.17/2012, actualizate cu indicele de inflaţie de la data reţinerii până la data restituirii fiecărei sume în parte. Menţine restul dispoziţiilor cu privire la ceilalţi reclamanţi.
Irevocabilă.
