Nefondat
Respinge, ca nefondate, apelurile declarate de inculpatul N****** N****** şi părţile civile Bela Ernest, Bondrea Vasile, Cîrlan Christa Karin, Conescu Maria, Creţu Georgeta, Iubitu Gheorghe, Morariu Maricica, Paise Ion şi Zichil Angela împotriva sentinţei penale nr. 45/S/11.10.2012 pronunţată de Tribunalul Pentru Minori şi Familie Braşov în dosarul penal nr. 10559/62/2011, pe care o menţine.
În baza art. 189 Cod procedură penală suma de 22.100 lei reprezentând onorariile avocaţilor din oficiu pentru intimaţii părţi civile se avansează din fondurile Ministerului Justiţiei şi se includ în cheltuielile judiciare.
În baza art.192 alin.2 Cod procedură penală obligă pe apelantul inculpat N****** N****** la plata sumei de 23.000 de lei şi pe apelanţii părţi civile Bela Ernest, Bondrea Vasile,Cîrlan Christa Karin, Conescu Maria, Creţu Georgeta, Iubitu Gheorghe, Morariu Maricica, Paise Ion şi Zichil Angela la plata a câte 250 de lei fiecare reprezentând cheltuieli judiciare avansate de stat în apel.
Cu drept de recurs în 10 zile de la pronunţare pentru apelanţii Creţu Georgeta, Cîrlan Christa Karin, Conescu Maria, Paise Ion şi Zichil Angela şi de la comunicare cu restul părţilor.
