Admite apelul. Schimbă, în parte, sentinţa civilă nr. 2551/10 aprilie 2013 a Judecătoriei Suceava, în sensul că: Respinge sesizarea, ca nefondată, în ceea ce priveşte planul de amplasament şi delimitare şi fişa corpului de proprietate, existente la f. 136 şi 137, dosar penal nr. 3561/P/2006. Respinge cererea pentru suspendarea executării sentinţei, ca rămasă fără obiect. Menţine celelalte dispoziţii ale sentinţei civle, care nu sunt contrare prezentei decizii. Cu drept de recurs în termen de 15 zile de la comunicare. Pronunţată în şedinţa publică din data de 28.11.2013.
